Use of Name, Logo & Identity

SHIVASHISH FOUNDATION

1. Definitions

• “Foundation” refers to Shivashish Foundation, a non-profit / NGO registered under applicable Indian laws.
• “Name” includes the words Shivashish Foundation, abbreviations, translations, logos, emblems, slogans, letterheads, stamps, seals, and social media identities.
• “Authorized Person” means a trustee, office bearer, employee, volunteer, or partner having written approval from the Foundation.

2. Ownership & Intellectual Rights

• The name SHIVASHISH FOUNDATION and all associated intellectual property rights are the exclusive property of the Foundation.
• No ownership rights are transferred by granting permission to use the name.
• Unauthorized use shall be treated as infringement.

3. Permitted Use

The name may be used only for:

• Official NGO activities
• Approved social welfare programs
• Government or donor-approved projects
• Internal documentation and awareness campaigns

Written authorization is mandatory.

4. Restricted & Prohibited Use

The name shall NOT be used for:

• Personal or commercial gain
• Political activities or campaigns
• Religious promotion or conversion
• Illegal, misleading, or immoral purposes
• Unauthorized fundraising or donation collection
• Opening bank accounts, UPI IDs, or wallets
• Issuing receipts, certificates, or ID cards without approval
• Any act harming the reputation of the Foundation

5. Fundraising & Donations

• No person may collect funds in the name of the Foundation without written permission.
• All approved fundraising must use official bank accounts and receipts.
• All activities must comply with Indian laws and regulations.

6. Media & Public Communication

Prior written approval is required for:

• Posters, banners, pamphlets, and hoardings
• Websites and social media accounts
• Advertisements, videos, and press releases

7. Misrepresentation & Impersonation

• No person may claim representation of the Foundation without authorization.
• Impersonation will invite civil and criminal action.

8. Termination of Authorization

• The Foundation may revoke permission at any time without notice.
• Upon termination, all use of the name must stop immediately.

9. Liability & Indemnity

• The Foundation is not liable for unauthorized acts done in its name.
• The violator shall bear full responsibility for damages or legal consequences.

10. Legal Action & Penalties

• The Foundation may initiate civil or criminal proceedings.
• All legal costs may be recovered from the violator.

11. Amendment of Terms

The Foundation reserves the right to amend these Terms & Conditions at any time.

12. Governing Law & Jurisdiction

These terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction State (Delhi).

13. Acceptance

Any use of the name SHIVASHISH FOUNDATION shall be deemed acceptance of these Terms & Conditions.
